Words with capitalized first letters have meanings defined under the following conditions. These definitions apply whether they appear in singular or plural form.

Definitions

For the purposes of these Terms and Conditions:

  • Service refers to painting, staining, surface preparation, and any related services provided by the Company.

  • Site refers to any property where painting or related work is performed.

Acknowledgment

These Terms govern the use of our services and form the agreement between you and the Company. By accepting a quote, signing a contract, or allowing work to begin, you agree to these Terms. If you do not agree, please do not proceed with our services.

Estimates and Contracts

  • Estimates provided by us are valid for 30 days unless stated otherwise.
  • A signed contract or written approval is required before work begins.
  • Prices in estimates are subject to change if additional work or materials are required due to unforeseen conditions (e.g., water damage, mold, or structural issues).
  • Changes to the original scope of work may result in additional charges.

Scheduling and Project Timeline

  • We strive to complete projects within the estimated timeframe. However, weather conditions, material availability, or unforeseen circumstances may cause delays.
  • If you need to reschedule, we require at least 48 hours’ notice.
  • Failure to provide notice for cancellations or reschedules may result in a cancellation fee.

Payment Terms

  • A deposit of 25% is required before work begins, with the balance due upon project completion.
  • Payments must be made by cash, check, credit card, or other agreed-upon methods.
  • Late payments may incur a 10% late fee per month.
  • If payment is not received within 30 days, we reserve the right to take legal action or place a lien on the property.

Customer Responsibilities

  • The customer must provide access to the site during working hours.
  • Valuable items, furniture, and decor should be removed or protected before work begins. We are not liable for damage to unprotected items.
  • The customer is responsible for ensuring the work area is clear of pets, children, or obstructions.

Workmanship and Warranty

  • We guarantee our workmanship for 1 Year from the completion date.
  • This warranty covers peeling, blistering, or chipping due to improper application but does not cover damage caused by external factors (e.g., water leaks, structural shifts, or harsh environmental conditions).
  • If a warranty issue arises, we will inspect the problem and determine the appropriate resolution.

Limitations of Liability

  • We are not responsible for pre-existing conditions such as mold, structural defects, or prior paint failure.
  • Minor variations in color or sheen due to material differences or lighting are not considered defects.
  • Our liability is limited to the cost of services provided. In no event shall we be liable for indirect, incidental, or consequential damages.

Job Site Conditions

  • We will take reasonable precautions to protect surfaces and belongings from paint spills or damage.
  • Some level of dust or paint fumes is unavoidable; customers should take necessary precautions if they have allergies or sensitivities.
  • If hazardous materials (e.g., lead-based paint, asbestos) are discovered, work will pause until proper remediation is completed.

Termination

  • We reserve the right to stop work if:
    • The customer fails to make payments as agreed.
    • Unsafe working conditions exist.
    • The customer requests unauthorized work outside of the contract.
  • If the contract is terminated by the customer after work has started, the customer is responsible for payment of all completed work and any materials purchased.

Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the State of Michigan.

Dispute Resolution

  • We aim to resolve disputes amicably. If an issue arises, the customer agrees to first attempt to resolve the matter directly with us.
  • If a resolution cannot be reached, both parties agree to mediation or arbitration before pursuing legal action.

Changes to These Terms

We reserve the right to modify these Terms at any time. The most current version will be available on our website or provided upon request.
